1. Acceptance of Terms

Welcome to NoKara! These Terms of Service ("Terms") govern your access to and use of the NoKara mobile application ("App"), operated by NoKara ("we", "us", or "our").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. Description of Service

NoKara is a community-powered mobile application that allows users to:

  • Report power blackouts in real-time
  • View active blackouts on an interactive map
  • Track blackout history and statistics
  • Access official UEDCL outage announcements
  • Share blackout information with other users

The service is provided free of charge and relies on community participation for accuracy and effectiveness.

3. User Responsibilities

3.1 Accurate Reporting

You agree to:

  • Report blackouts accurately and truthfully
  • Update blackout status when power is restored
  • Not submit false, misleading, or fraudulent reports
  • Use the App for its intended purpose only

3.2 Appropriate Use

You agree NOT to:

  • Use the App for any illegal or unauthorized purpose
  • Attempt to interfere with the App's functionality or security
  • Reverse engineer, decompile, or disassemble the App
  • Submit spam, malicious content, or excessive reports
  • Harass, abuse, or harm other users
  • Violate any applicable laws or regulations

3.3 Account Security

While NoKara uses anonymous authentication, you are responsible for:

  • Maintaining the security of your device
  • Any activity that occurs through your device
  • Notifying us immediately of any unauthorized access

4. Intellectual Property Rights

4.1 Ownership

The App and its original content, features, and functionality are owned by NoKara and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

4.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes, subject to these Terms.

4.3 User Content

By submitting blackout reports, you grant NoKara a worldwide, non-exclusive, royalty-free license to use, display, and distribute your reports within the App and for aggregated statistics.

5. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • The accuracy, reliability, or completeness of blackout reports
  • The availability or uninterrupted operation of the App
  • The fitness for a particular purpose
  • The merchantability of the service

NoKara is a community-powered platform. We do not verify the accuracy of user-submitted reports and cannot guarantee that all blackout information is current or accurate.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOKARA SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, use, or other intangible losses
  • Damages resulting from your use or inability to use the App
  • Damages resulting from reliance on blackout reports or other user-generated content
  • Any conduct or content of third parties on the App

This limitation applies regardless of the legal theory (contract, tort, negligence, or otherwise) and even if NoKara has been advised of the possibility of such damages.

7. Indemnification

You agree to indemnify, defend, and hold harmless NoKara and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including legal fees, arising out of or in any way connected with:

  • Your access to or use of the App
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your reports or other content submitted to the App

8. Data and Privacy

Your use of the App is also governed by our Privacy Policy, available at https://nokara.ug/privacy.html. By using the App, you consent to the collection and use of information as described in the Privacy Policy.

9. Third-Party Services

The App uses third-party services, including:

  • Firebase (Google): For authentication, database, and analytics
  • Google Maps: For map display and location services

Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of these third-party services.

10. Modifications to the Service

We reserve the right to:

  • Modify or discontinue the App (or any part thereof) at any time, with or without notice
  • Update, change, or remove features from the App
  • Impose limits on certain features or restrict access to parts of the App

We will not be liable to you or any third party for any modification, suspension, or discontinuation of the App.

11. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including:

  • Breach of these Terms
  • Fraudulent or abusive behavior
  • Violation of applicable laws

Upon termination, your right to use the App will immediately cease. You may also terminate your use by uninstalling the App.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Uganda, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of Uganda.

13. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by:

  • Updating the "Last updated" date at the top of these Terms
  • Posting a notice in the App
  • Sending a notification through the App (if applicable)

Your continued use of the App after such modifications constitutes your acceptance of the updated Terms.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to be valid and enforceable to the fullest extent permitted by law.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and NoKara regarding your use of the App and supersede any prior agreements.
